• You are responsible for all activities that occur under your account.
• You must provide accurate and complete information when creating your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Credits and Payments

• Credits are required to use AI generation features on the Platform.
• Credit prices and generation costs are displayed on the Platform and may change at any time.
• Purchased credits are non-refundable except where required by applicable law.
• Credits have no cash value and cannot be transferred to other users.
• We reserve the right to modify credit pricing and generation costs with reasonable notice.

5. Acceptable Use

You agree not to use the Platform to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Generate content that infringes on the intellectual property rights of others.
• Generate content depicting minors in inappropriate or harmful situations.
• Attempt to bypass content safety filters or moderation systems.
• Use automated systems or bots to access the Platform without authorization.
• Reverse engineer, decompile, or attempt to extract the source code of the Platform.
• Interfere with or disrupt the Platform or its infrastructure.

6. Generated Content

• Content generated through the Platform is created by third-party AI models. We do not guarantee the accuracy, quality, or appropriateness of generated content.
• You retain rights to content you generate, subject to the terms of the underlying AI providers.
• We may store your generated content to provide the service and improve the Platform.
• You are solely responsible for how you use and distribute content generated through the Platform.

7. Intellectual Property

The Platform, including its design, features, and underlying technology, is owned by Artiofy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. AI-generated content may contain inaccuracies, biases, or unexpected results.

9. Limitation of Liability

To the fullest extent permitted by law, Artiofy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We may also update these Terms of Service periodically. Your continued use of the Platform after any changes constitutes acceptance of the new terms.

11. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will cease immediately. Any unused credits may be forfeited upon termination for cause.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Platform shall be resolved through good faith negotiation first, and if necessary, through binding arbitration.
